Our privacy policy describes how information provided by members is handled while under our care and control.  Privacy is a high priority at GoFastAuction, and we want all our members to be assured personal data is secure here. 

Scope

Acceptance of the User Agreement and Privacy Policy during the registration process is required to become a GoFastAuction member.  By doing so, the member agrees and gives permission to the collection and storage of information in addition to disclosing information pursuant to terms described here. 

The policy provisions are effective at registration time for new members and became effective for other users on DATE.

Information Use

The collection of personal information is primarily used to provide a safe and efficient, trading environment.  Users permit the use of personal information for the following:

• Prevent prohibited and/or illegal actions by members or visitors to the site, enforcement of the GoFastAuction User Agreement and compliance with legal investigations performed by duly authorized law enforcement agencies of the United States.

• Dispute resolution, fees collection, and the settlement of other issues that may arise during the course of site administration.

• Providing requested customer support, resolution of issues of technical or commercial nature and site administration activity designed to improve services and content.

• Notification of service updates, policy changes, new promotions or other GoFastAuction marketing activities

Information Collection

Casual site browsers do not reveal any information to GoFastAuction and therefore are not subject to the GoFastAuction Privacy Policy.  Those presenting information to GoFastAuction agree to the storage and distribution of any data provided. 

The following information categories represent the types of information GoFastAuction may collect, store or transfer:

• Log-in information, page view statistics, IP address(es) and standard web log information.

• Email and postal mail addresses and other pertinent contact information.  This information may include shipping, billing and other data provided during the course of purchasing or shipping an item.

• Financial information, including credit card or bank account numbers, that may be in our possession.

• Transaction, bidding and selling history and all content generated relating to your membership.

• Dispute information and resolution, correspondence to management or others made through GoFastAuction.

• Other information provided by third parties including, but not limited to, driver’s license information and credit reports. 

Marketing Data

GoFastAuction never sells or rents member information to third party marketing concerns without direct and written permission.  We reserve the right to utilize information provided for internal management use without further expressed permission. 

Information Disclosure

The provision of personal information by our membership is regarded as a special trust, and GoFastAuction handles the data accordingly.  There are instances such as compliance with law enforcement or the protection of other member’s rights that may prompt the disclosure of information to others.  In general, any request for information involving the protection of any individual’s rights, safety or property will be deemed a viable reason to disclose information to appropriate but restricted number of individuals. 

Below are a number of other scenarios in which we may disclose personal information to specified personnel:

• Other business entities we may merge with or be acquired by in the future with the provision they respect a similar version of the privacy policy GoFastAuction has in effect at the time.

• Department personnel within GoFastAuction working to uncover or prevent possible illegal activities or who may be involved in concurrent marketing programs to which the member has already provided consent to be party to.

• Law enforcement or other U.S. Government officials requesting information regarding an active criminal investigation or alleged illegal activity.  To the extent possible, we will verify the authority of the requesting individual, the validity of the investigation and jurisdiction of the requesting agency, in addition to the legal standing of GoFastAuction prior to revealing any data.  In most cases, disclosure will require a substantial legal action in the form of a subpoena, court order or other order from a recognized authority with appropriate jurisdiction. 

• Other individuals or organizations for which GoFastAuction has a documented request from the member to forward information.

• Any circumstance in which GoFastAuction has a good faith reason to believe the disclosure of information may prevent imminent harm to the health, welfare, property or financial standing of an innocent party or when the failure to report information may be considered illegal or an act of conspiracy in a suspected crime.

GoFastAuction Security

GoFastAuction information is stored on servers within the United States, and is protected as an asset of the company.  Every effort is expended to prevent unauthorized personnel from accessing or disclosing information stored on GoFastAuction servers.  Internet communications are potentially vulnerable to unlawful interception during the course of transmission which GoFastAuction cannot control.  Additionally, other users may misuse personal information collected from the site for purposes other than originally intended.  In the present Internet climate, it is unreasonable for a user to expect any guarantee of complete privacy and no such warranty will ever be provided or implied by GoFastAuction.  All members are advised to exercise discretion at all times.

User ID Activity

User IDs are publicly displayed throughout the site as part of the auction environment.  All trading and related activities on the site are directly linked to a User ID for the purpose of enhancing the trading experience. Suspicious or illegal activities associated with a User ID will be transmitted to other community members as required to ensure a safe trading forum.  GoFastAuction is not responsible for User IDs that reveal a member’s legal name or consequences regarding personal reputation or community standing arising from the posting of activity associated with a User ID.

Cookies

Small files placed on visitor hard drives called "cookies" help promote safety and tailor our services to better serve our community.  Cookies do not pose a threat to your computer and are widely used on most commercial Internet sites.

Cookies are most often used for the following purposes:

• Some aspects of the site are made possible only with the use of cookies.

• Cookies identify the user and maintain log-in status.

• “Session cookies" are the most common use of cookies at GoFastAuction, and these cookie types are designed to be automatically deleted at the end of a website session.

• Most browsers offer the option of declining cookies, but that selection could interfere with some attributes of this and other Internet sites.

Information Obtained at GoFastAuction

GoFastAuction lists very limited information regarding other users' contact information.  Some contact information is required to make transactions possible, but the amount of information provided is restricted to protect user privacy.

During the course of a transaction, both parties may have access to vital facts about each other, including the user’s name, User ID, email address or other contact information.  GoFastAuction members agree to give other users the opportunity to review any information collected about them and the option to remove their data from any data storage software in the user’s possession.  

GoFastAuction does not guarantee the privacy or security of your information, and we recommend all users to evaluate the privacy policies of trading associates prior to sharing information during a transaction.

GoFastAuction members further agree to restrict their use of other’s information for:

• Reasons directly related to concluding a transaction such as escrow services, shipping, etc.

• Other purposes expressly requested by a transaction partner.

Spam and Spyware

Members using our community or the information found here for the purposes of sending spam (unsolicited email) will have their membership immediately revoked.  Members are further restricted from adding any member’s information to any mass-distribution contact list involving any communication technology including, but not limited to, email, telephone or postal mail. 

Sending any content in violation of our User Agreement is also forbidden.  Emails sent with spyware or other unauthorized files that may interfere with the operation of another’s computer is prohibited and may be in violation of U.S. law.  Users are encouraged to report this activity immediately to GoFastAuction management. 

GoFastAuction does not rent or sell email addresses in our possession.

Account Protection

A User password is the most vital security tool for your GoFastAuction account.  Never disclose your password to anyone.

Losing control of a user password is a serious matter that could lead to the unauthorized use of personal information or being legally bound to a transaction conducted with the User ID. 

User IDs are issued to one person only, and it is highly recommended the ID and password are not shared with anyone for any reason.  The person to whom the ID was originally issued is legally responsible for all actions conducted with the ID including any purchases or bids. 

Members who believe their password has been compromised should immediately change the password.

Modifying Personal Information

Most personal information can be modified when logged into the Site.  Members are required to update personal information when it changes or is incorrect.  When a member closes an account, GoFastAuction removes the user’s personal information from view as soon as reasonably possible.  We reserve the right to retain personal information from closed accounts to comply with law, collect owed fees, resolve disputes, prevent fraud and enforce our User Agreement.

Information Provided to Third Parties

This privacy policy is intended for information provided to GoFastAuction management from its membership.  Information disclosed to parties other than GoFastAuction is subject to that party’s privacy policy, because GoFastAuction has no control over the policies of others.  Please inquire how requested information is handled before providing personal information to anyone.

General

This policy may be changed at any time, and members will be notified of modifications by posting the new terms on the site.  Thirty days after the new terms are posted, the terms will take effect.  Notify GoFastAuction management of any questions or concerns about policy changes by using the “Contact Us” feature on the site.
